Florida Public Records Law

Florida's public records law is among the strongest in the nation. Article I, Section 24 of the Florida Constitution enshrines the public's right to access government records. Chapter 119 of the Florida Statutes implements that right, applying it to all state, county, and municipal agencies. The law covers records in any form, whether paper, electronic, audio, or other media. Any person may request any public record. You do not need to be a resident. You do not need identification. You do not need a written form or an attorney.

Section 119.07 requires any custodian of a public record to permit inspection and copying at any reasonable time and under reasonable conditions. Copy fees are set by statute: $0.15 per one-sided page, with no more than $0.05 additional for double-sided copies. Certified copies run $1.00 per page plus a $5.00 certification fee. If compiling your request requires more than 30 minutes of staff time, the agency may charge for that extra time at the rate of the lowest-paid employee qualified to do the work. For most simple requests, there is no cost.

Exemptions exist for some records, including certain law enforcement files, medical records, juvenile records, and other specified categories. When an agency withholds a record, it must tell you the specific statutory basis.
